Terms of Service

Draft. These terms have not yet been reviewed by a lawyer. They will be finalized before game tokens, NFTs or prize rewards go live.

These Terms of Service (“Terms”) are an agreement between you and Rumble Town LLC, a Wyoming limited liability company(“Rumble Town LLC”, “we”, “us”). They cover rumbletown.xyz, the Rumble Town game on web and mobile, and any related services, tokens, NFTs, rewards and communities we run (together, the “Services”). By using the Services you agree to these Terms. If you don’t agree, please don’t use them.

Our Privacy Policy and Token & NFT Disclaimer are part of these Terms.

1. Who can use Rumble Town

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you.

To hold, claim, buy, sell or trade game tokens or NFTs, or to receive rewards with real-world value, you must be at least 18 years old (or the age of majority where you live, if higher) and legally allowed to do so. You may not use those features if you live in, or are a resident of, a country or region subject to comprehensive U.S. sanctions, or if you are on a U.S. or other applicable sanctions list. We may limit or switch off features in any location where they would not be lawful.

2. Accounts and wallets

You can play the demo without an account. Some features need an account, which you can create with an email address or a supported sign-in provider. Keep your login details safe and tell us if you think someone else has used your account.

When you sign in, a blockchain wallet may be created for you through a third-party wallet provider, or you can connect your own self-custody wallet (such as Phantom or Solflare). You are responsible for your wallet, its recovery phrase and every transaction signed from it. We never ask for your recovery phrase or private keys, and we can’t recover them or reverse transactions on the blockchain.

3. The game and in-game items

Rumble Town is a game for entertainment. We may change, balance, add or remove characters, cities, modes, items and features at any time, including the stats and abilities of Bonkos. Scores, levels and in-game items that are not recorded on a blockchain have no monetary value and can’t be exchanged for money.

The game is still in development. Demos, betas and test seasons may contain bugs, may be reset, and may stop working without notice. Test-network (devnet) tokens and NFTs have no value.

4. Tokens and NFTs

Rumble Town may use a game token on the Solana blockchain as in-game currency, and NFTs that represent playable characters and items (“Digital Assets”). Digital Assets are made for use in the game. They are not shares, securities, investments or a claim on Rumble Town LLCor its profits, and we make no promise that they will have, keep or increase in value.

5. Leaderboards and rewards

We may run leaderboards, seasons, missions and events that award tokens, NFTs or other prizes to top players. Each reward program will have its own rules (eligibility, dates, how winners are decided and what they receive), which apply together with these Terms. Unless a program’s rules say otherwise:

Multiplayer matches and community spaces may include chat. Keep it friendly: no hate speech, sexual content, threats, spam, scams or sharing other people’s personal information. You keep ownership of what you post, but you give us a worldwide, royalty-free license to host, display and moderate it to run the Services. We may remove content and mute or ban players who break these rules.

8. Intellectual property

Rumble Town, the Bonkos (including Bonko, Sizzle and Kaboomi), our logos, artwork, music, code and other content are owned by Rumble Town LLC or our licensors and are protected by law. We give you a personal, non-exclusive, revocable license to use the Services for your own entertainment.

If you own a Rumble Town NFT, you may display its artwork for personal, non-commercial purposes, such as a profile picture or in posts about the game, for as long as you own it. Any commercial use needs our written permission. You may not use our art or marks in a way that suggests we endorse you, or in connection with hateful, illegal or misleading content.

9. Third-party services

The Services rely on and link to services we don’t control, including the Solana blockchain, wallet providers, NFT marketplaces, app stores, sign-in providers and payment providers. Their own terms and privacy policies apply, and we are not responsible for their availability, security or actions. If you got the game from the Apple App Store or Google Play, their terms also apply, and those stores are not responsible for the game or for supporting it.

10. Disclaimers

The Services and Digital Assets are provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don’t promise that the Services will be uninterrupted, secure or error-free, or that any Digital Asset will have or keep any value.

11. Limitation of liability

To the fullest extent allowed by law, Rumble Town LLC and its members, managers, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or loss or theft of Digital Assets, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or US $100.

Some places don’t allow these limits, so some of them may not apply to you.

12. Indemnity

You agree to defend and reimburse Rumble Town LLC for claims, losses and costs (including reasonable legal fees) that arise from your breach of these Terms or your misuse of the Services.

13. Suspension and termination

You can stop using the Services at any time. We may suspend or close your account, or block access to features, if you break these Terms, if the law requires it, or if we stop offering the Services. Closing an account does not remove NFTs or tokens from your self-custody wallet, but they may no longer work in the game. Sections 4, 8 and 10 to 14 continue to apply after termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Before filing a claim, please contact us at hello@rumbletown.xyz so we can try to solve the problem informally within 30 days. If that doesn’t work, any dispute will be brought in the state or federal courts located in Wyoming, and you and we consent to their jurisdiction. Nothing in this section takes away consumer protection rights you have under the law where you live.

15. Changes and contact

We may update these Terms. We’ll change the date at the top, and for material changes we will give reasonable notice, for example on the site or by email. If you keep using the Services after changes take effect, you accept the updated Terms.
